Foreign inspections

The term “foreign inspections” refers to inspections conducted by foreign authorities, officials, or respective delegated institutions.

Pursuant to Article 2 Staatsschutzgesetz, inspections carried out in Liechtenstein by foreign authorities, officials, or respective delegated institutions are illegal unless authorization has been granted for such an inspection. Consequently, any foreign inspection conducted without authorization constitutes an illegal act within the meaning of Article 2 Staatsschutzgesetz and may result in the prosecution of both the foreign inspectors and the management of the inspected company.

Authorization Procedure

The foreign authority or the respective delegated institution must submit an application to the Office of Public Health no later than 40 days before the planned start of the inspection (by email to: medical.devices@llv.li).

Alternatively, the application may be submitted to the competent embassy (*). The embassy will ensure that the application is forwarded to the Office of Public Health.

The application must include the following information and documents:

  • Name, address, and contact person, including e-mail address and telephone number, of the company based in Liechtenstein to be inspected
  • Name, address, and contact person, including e-mail address and telephone number, of the applying authority or respective delegated institution
  • Scope of the inspection
  • Detailed information on the inspection procedure (program)
  • Planned inspection date(s)
  • Names of the inspectors and experts assigned to conduct the inspection, including:
    • Information on the department of the authority/institution to which the inspectors/experts belong
    • Information on the function of the inspectors/experts within this department (e.g. inspector, investigator, expert)
    • Information on the professional background of the inspectors/experts (e.g. pharmacist, chemist, microbiologist)
    • Photocopies of the passports of the inspectors/experts

After completion of the inspection, the foreign authority or respective delegated institutions must inform the Office of Public Health of the results by submitting the inspection report in German or English. This inspection report must be notarized.

(*) In all countries in which Liechtenstein has no official representation, the application may be submitted to the Swiss embassy.
