Trade in tobacco and related products in the Swiss-Liechtenstein customs union

Natural or legal persons domiciled or resident in Liechtenstein who purchase tobacco products and related products exclusively from Switzerland or a third country and also only place them on the market in the Swiss-Liechtenstein customs union must comply with the provisions of the Swiss Tobacco Products Act and its ordinance declared applicable in Liechtenstein. In addition, the Liechtenstein provisions on tobacco prevention and Youth Protection Bureau must be observed.

The provisions of the EEA Tobacco Products Ordinance do not apply as long as there is no direct or indirect exchange of goods with EEA countries. Trade in tobacco and related products in the EEA).

Anyone who makes tobacco products or electronic cigarettes available on the market of the customs union is obliged to self-monitoring compliance with the requirements of this law (Art. 25 TabPV). The detailed requirements for self-monitoring can be found in Art. 21 of the TabPV.

The self-monitoring to ensure that the products comply with the legal requirements must be documented and includes in particular

  1. the aspects to ensure standardized manufacture of the products in accordance with the procedures laid down by the manufacturer or, where applicable, by the tobacco product or electronic cigarette industry;
  2. the taking of samples and their analysis and the description of the methods used;
  3. the withdrawal and recall, if applicable.

The self-monitoring documentation must be updated regularly.

Anyone who manufactures or imports tobacco products or electronic cigarettes must notify the Federal Office of Public Health (FOPH) within one year of making them available on the market (Art. 26 TabPA). Market participants are responsible for the correct transmission of information. A new notification must be submitted for each significant change to the product.

The notification must contain the following information:
  1. Company name;
  2. Product category in accordance with Article 3 letters a-f;
  3. Product brand;
  4. Product composition, including additives;
  5. Functions of the ingredients used.

For certain products, the notification must also contain the following additional information:
  1. for cigarettes: tar, nicotine and carbon monoxide content;
  2. for herbal smoking products: Certificate proving that the product does not contain nicotine or substances with psychotropic effects;
  3. for products with nicotine-containing liquid: nicotine content.

The person making the notification must also submit the studies and scientific information available to them regarding the product composition and additives.
