National thresholds
The national thresholds for direct awards and the negotiated procedure are defined in Articles 25 and 26 of the Ordinance on Public Procurement ÖAWV. Above these contract values for direct awards or for negotiated procedures, the open or restricted procedure(Article 22(5) of the Public Procurement Act) must generally be used.

Exceptional provisions for the permissible use of the negotiated procedure are regulated in Article 25 of the Ordinance on Public Procurement.
Depending on their appropriateness,contracting authorities in the sectors award contracts by open procedure, restricted procedure, negotiated procedure, competitive dialog or within the framework of an innovation partnership(Art. 33 para. 1 ÖAWSG).
