The Gambling Act provides for two categories of lottery organizers: large-scale organizers that generate stakes of 100,000 francs or more per year and small-scale organizers.

The small-scale organizers, in turn, are divided into three subcategories:

  • Small event organizers, which generate stakes of less than 100 000 francs per year;
  • Small event organizers that generate stakes of 25 000 francs or more per year, use the stakes for non-profit or charitable purposes, and receive a significant portion of the profits free of charge;
  • Small promoters who generate stakes of less than 25 000 francs per year, who use the stakes for non-profit or charitable purposes and receive a substantial portion of the profits provided free of charge.

The commercial or public conduct of lotteries is subject to licensing.

For large-scale organizers, the Gambling Act provides for a dual licensing system in that the organizer requires on the one hand an organizer permit from the government and on the other hand for each individual game a gaming permit from the Office of National Economy. There is no legal entitlement to the granting of an organizer permit.

For small-scale organizers, the Office of National Economy issues a combined organizer and game permit. Small-scale organizers who generate stakes of less than 25 000 francs per year, who use the stakes for non-profit or charitable purposes and who receive a significant part of the profits free of charge are only subject to a notification requirement.

The organizers of a raffle must also merely report this to the Office of National Economy.

Organizers of lotteries and betting conducted online require a concession for the organization of online gambling.
