Office of the Public Prosecutor

The Office of the Public Prosecutor is ex officio responsible for investigating and prosecuting all criminal offences of which it gains knowledge and which are not subject to investigation and punishment merely at the request of an involved party, and for presenting the charges before the competent court.

The Office of the Public Prosecutor is responsible for the following tasks:

  • The Office of the Public Prosecutor safeguards the interests of the country in the administration of justice, particularly in the administration of criminal justice and mutual legal assistance in criminal matters. It is independent of the courts in the fulfilment of its duties.
  •  As part of the principle of legality, the Office of the Public Prosecutor examines all reports of criminal offences that it receives and which are to be pursued ex officio. If there are sufficient grounds to initiate proceedings, the Office of the Public Prosecutor submits an application to initiate an investigation or issues an indictment. Otherwise, the Office of the Public Prosecutor discontinues the proceedings.
  • The Office of the Public Prosecutor represents the public prosecution before the judge sitting singly, the juvenile court, the criminal court, the High Court, the Supreme Court and, in customs contract matters, before the Cantonal Court of St. Gallen.
  • According to the General Civil Code, the Office of the Public Prosecutor has a right to participate in proceedings concerning the contestation of the marital status of a child and the annulment of a marriage.
