Registered trust enterprise

The trust enterprise is a company, in accordance with the trust articles, managed or further operated  by one or several trustees under their own name or legal name which pursues, as a legally autonomous undertaking, economic or other objects and is endowed with its own assets.

The trust enterprise may be established like a foundation or a corporation. Most common are trust enterprises which have neither members nor partners or shareholders and thus have no capital divided into shares. However, the trust enterprise knows beneficiaries, i.e. persons who can derive economic benefit from the trust enterprise.

Trust enterprises were distinguished in trust enterprises with legal personality and trust enterprises without legal personality. In practice, the legal enterprise without legal personality is very seldom.

The trust enterprise must be registered in the commercial register.

The Office of Justice does not draw up deeds or contracts, except drawing up the public deeds required by law and providing assistance with the submission.
