Procedure for revocation or declaration of invalidity

The registration of a trademark may be revoked or declared invalid upon request. The application for revocation or for a declaration of invalidity shall be filed in writing with the Office of Economic Affairs, stating the facts and evidence supporting it.

The Office of Economic Affairs shall inform the owner of the registered trademark of the initiation of the proceedings and give him/her the opportunity to comment.

If no objection is filed within one month, revocation or invalidity shall be declared, the registration shall be cancelled for those goods and services against which the application is directed, and the revocation or invalidity proceedings shall be deemed closed.

Otherwise, the Office of Economic Affairs shall inform the applicant of the timely objection. The fee for pursuing the revocation or declaration of invaliditay proceedings shall be paid within one month. Otherwise, the revocation or delaration of invaliditay proceedings shall be deemed to be completed. 

If the application for revocation or ivalidity is granted, the trademark registration shall be cancelled in whole or in part.
