Real estate liens

A pledge agreement forms the basis for the pledging of a property in favor of a creditor. The property serves the creditor as security for a mortgage loan granted.

A pledge agreement must have the following essential components:

  • the contracting parties (pledgor and pledgee), in the case of a third-party debt relationship also the debtor;
  • the exact property designation;
  • the pledge promise of the landowner or the landowner;
  • the consent of the spouse or registered partner, if the pledged property is the house or apartment of the family or the joint home;
  • the designation of the type of real estate lien (capital or maximum real estate lien, register debt certificate);
  • the reference to the total pledge in the case of several properties;
  • the claim to be secured in the mortgage;
  • the pledge amount (does not have to be identical with claim / debt amount);
  • the maximum interest rate, if such is to be registered.
