Data protection notice In the following, we, the Office for Building Construction and Spatial Planning (AHR) as the responsible body, inform you in accordance with Art. 13 and Art. 14 of the EU General Data Protection Regulation (GDPR) about the manner and background of the processing of your personal data in connection with our activities.

The following information applies equally to applicants for building permits in the notification procedure, applicants in the ordinary building permit procedure, applicants in the procedure for the granting of subsidies in accordance with the housing subsidy legislation and other persons affected by the data processing.

The primary purpose of processing personal data is to fulfill the legal mandate incumbent upon us as a building authority. This includes, in particular, the examination of the conditions for the granting of building permits and approvals, as well as the overall implementation of the procedures under the applicable provisions of the building legislation and the examination of the conditions for the granting of subsidies under the housing subsidy legislation and the corresponding awards.

Primarily, we perform the following processing activities:

  • Capture and processing of construction notifications and planning applications
  • Execution of the procedures under building law, in particular the ordinary building permit procedure (Art. 50 ff. BauG) as well as the notification procedure (Art. 62 ff. BauG) under
  • involving the official bodies and municipalities concerned, and under
  • Guaranteeing the legal position of neighbors within the framework of the notification and objection procedure (Art. 77 BauG)
  • Leading the procedure for the approval of subsidies under the housing subsidy legislation.

The legal basis for the processing activities is recorded in the area of responsibility of the building authority in Art. 97a Building Act (BauG; LGBl. 2009 No. 44 idgF). For companies, electronic communication is mandatory pursuant to Art. 5 (1) of the Electronic Commerce Act (E-GovG); natural persons can choose between submitting the building application electronically or physically. The legal basis for the processing activities is set out for the area of responsibility under the Housing Promotion Act in Art. 30a of the Housing Promotion Act (WBFG; LGBl. 1977 No. 46 as amended)

The following personal data are collected, recorded and processed in the course of our activities:

  • Name, first name, address, company in case of business, e-mail address, telephone number of
  • Owner / builder / developer / applicant in WBF matters
  • co-owner if applicable
  • project architect
  • Construction supervisors / site managers / civil and test engineers / geologists / specialist planners
  • Neighbors (only in case of objections according to Art. 77 BauG)
  • Property number / ownership according to land register extract / WOID apartment identification number / GEID building identification number
  • in housing subsidy matters also data concerning income and assets

If the data is not collected from you personally, the information on personal data comes from the following sources: Geodata Portal Liechtenstein, Central Register of Persons (ZPR).

The resources used by the Processors in the processing of personal data are as follows:

The cloud solution GemDat-CYMO is used for the input of the electronic building applications as well as for the communication with all parties involved until the application is closed by approval or rejection. An eCH interface is then used to transfer the data from the cloud to the CMI-Bau management software.

The use of the cloud will replace the previous, web-based online forms for submitting building applications. Natural persons who do not wish to take the e-building application route will be provided with a simplified form. Companies are required to submit their applications electronically under the E-GovG.

The construction management software CMI-Bau is used in the further procedure for handling building applications and is primarily used by us. If other public agencies are to be involved, we grant certain access rights and access options in the system.

We transmit your data in building procedures according to BauG only in legally required and permitted cases to the authorities and agencies responsible for the execution of the building legislation. The following can be considered as recipients of your personal data or as persons authorized to access it:

  • Municipality
  • Environmental Agency
  • Office of Civil Engineering and Geoinformation
  • Office of Culture
  • Office of Food Control and Veterinary
  •  Office of Civil Protection
  • Office of Public Health
  • Liechtensteiner Behindertenverband

The transfer of personal data to a third country or the access possibility is carried out within the framework of the order processing of both above-mentioned order processors in Switzerland. The data transfer to Switzerland is possible due to the adequacy decision of the EU Commission pursuant to Article 45 DSGVO.

The storage period for data processing in the CMI-Bau construction management system is governed by the Ordinance of 27 November 2018 on the Maintenance and Administration of Files in the Liechtenstein National Administration (LLV File Administration Ordinance LLV-AVV; LGBl. 2018 No. 264 idgF). If the purpose of the data processing has been achieved and if there are no legal retention periods, generally 10 years after file closure in accordance with the Persons and Companies Act (PGR), to prevent the destruction of your data, the personal data will generally be added to the respective deletion concept. The contents in the cloud solution are already automatically deleted with the completion of the respective building application and with transmission to the building management system.
