Data protection notice

In the following, the Office for the Environment, as the responsible body pursuant to Art. 13 and Art. 14 of the EU General Data Protection Regulation (GDPR), informs you about the manner and background of the processing of your personal data in connection with our activities. The following information applies equally to farmers, hunters, farm owners and private individuals as well as other persons affected by data processing.

The processing of personal data has the primary purpose of fulfilling the legal mandate incumbent upon us. This includes the general consultation as well as the authorization of installations and various interventions in nature and the environment of any kind. 

Principally, we carry out the following processing activities:

  • Maintaining asset registers
  • Preparation of permits for various installations or interventions in nature and the environment 
  • Preparation of ordinances on laws concerning the protection of nature and the environment
  • Disbursement of subsidies or other contributions in agriculture, nature conservation, environmental protection and forest
  • Control of compliance with legal requirements in the field of nature and environment protection and agriculture
  • Issuing hunting permits

The legal bases for the processing activities are set out in the provisions of the individual special laws on the protection of nature and the environment, in each case in conjunction with Article 6(1)(e) of the GDPR. These include, in particular, the regulations relating to environmental protection, nature and landscape conservation, water protection, forest conservation, hunting, fishing, species protection, soil conservation, the handling of organisms and climate protection. In addition, there are the customs treaty and EU directives and regulations. If the personal data are not processed on the basis of the public contract, the legal basis in individual cases is your consent pursuant to Art. 6 para. 1 let. a) DSGVO. For processing activities in connection with the issuance of hunting permits, furthermore, Art. 6 para. 1 let. e in conjunction with. Art. 10 DSGVO and Art. 21 para. 1 Bst. b No. 2 Data Protection Act.

The following personal data are collected, recorded and processed in the course of our activities:

  • For natural persons: Name, first name, address, address, telephone number and eMail address.For the issuance of hunting permits, data on criminal convictions and health data are also processed.  
  • For legal entities: Company address, eMail address, NOGA number, contact details of contact persons, number of employees.

If the data is not collected from you personally, the information on personal data comes from the following sources: Central Master Data FL (ZSD), land register.

The Office for the Environment transmits your data to the bodies entrusted with the implementation of audits and other procedures, which require them to perform their duties in accordance with the mentioned legal bases.

The transfer of personal data to Switzerland as a third country is based on the Customs Treaty. Switzerland has been certified by the EU Commission as having an adequate level of data protection in accordance with Article 45 of the GDPR.

The storage period of data processing is based on special legal requirements regarding retention periods or the archiving law. Once the purpose of the data processing has been achieved and there are no legal retention periods that prevent the destruction of your data, the personal data will be added to the appropriate deletion concepts.
