Notification obligation

According to Art. 59 of the Media Act of 19 October 2005, Liechtenstein Law Gazette 2005 No. 250, only the distribution of terrestrial or satellite radio or television programmes requires a programme licence.

For alternative distribution means, in particular distribution via the internet, notification pursuant to Art. 82a of the Media Act is sufficient, notifying about the intention to offer a broadcast-like television online medium. Art. 82a in conjunction with. Art. 5 para. 3 of the Media Ordinance of 13 December 2016, Liechtenstein Law Gazette 2016 No. 467 stipulates that, for the notification of such a service, a minimum amount of information needs to be communicated in addition to the declaration of intent of the notifying party in order for the licencing authority (Office for Communications, Ă„ulestrasse 51, Postfach 684, 9490 Vaduz) to be able to establish a register.

According to Art. 82a of the Media Act, this notification must contain a minimum amount of information, in particular information which is required to identify the company concerned and its intended programme.

Article 82a of the Media Act

1) Offering online media similar to broadcasting requires notification to the licencing authority.

2) Notification obligation pursuant to para. 1 includes:

a) a statement by the legal entity or natural person concerned declaring the intention to offer or discontinue the designated online medium;

b) minimum information required for the licencing authority to create a register or a list of persons/entities subject to notification. Such notification must include:

  1.  details identifying the persons/entities subject to notification;
  2.  designation of at least one contact person of the persons/entities subject to notification;
  3.  the address of the persons/entities subject to notification and the contact person(s);
  4.  a brief description of essential programme content; and
  5.  the date of the anticipated offering or discontinuation of the online medium concerned;

c) any change in information subject to notification obligation pursuant to sub-sections a and b.

3) The Government regulates any details regarding the notification obligation, including the levying of an appropriate annual notification fee, by Ordinance.
