Notification Obligation for Broadcasters and Providers under the Media Act

Broadcasting Programmes

The notification obligation for broadcasting a radio or television programme is governed by Article 59 of the Media Act of 19 October 2005 (Liechtenstein Law Gazette 2005 No. 250):

1) The broadcasting of a radio or television programme must be notified to the regulatory authority.

2) The notification must include:

a) a declaration by the relevant legal or natural person stating their intention to offer a radio or television programme;

b) the following minimum information for the maintenance of the register pursuant to Article 1a of the Media Act:

1. identification details of the notifying party;

2. designation of at least one contact person;

3. delivery address of the notifying party and the contact person(s);

4. a brief description of the essential programme content or catalogue; and

5. the anticipated start date of the broadcasting activity; and

c) the necessary information for full disclosure of ownership and trust structures as well as all legal relationships with broadcasters and companies in media-relevant markets.

3) Any changes to the information subject to notification under paragraph 2, as well as the discontinuation of the broadcasting activity, must be reported to the regulatory authority without delay.

4) The regulatory authority shall charge an appropriate annual supervisory fee to those subject to notification.

5) Further details regarding the notification obligation, including the levying of the supervisory fee, shall be regulated by government ordinance.

6) Communication law requirements remain unaffected.

On-Demand Audiovisual Media Services and Video-Sharing Platform Services

The provision of on-demand audiovisual media services and video-sharing platform services must also be notified to the regulatory authority in accordance with Article 82a of the Media Act.

Articles 59 paragraphs 2 to 6 of the Media Act apply mutatus mutandis, whereby the government regulates the details by ordinance in accordance with Article 28a paragraph 6 of Directive 2010/13/EU.

Supervisory Fee under the Media Regulation

According to Article 5 of the Media Regulation, broadcasters under Article 59 Media Act and providers of on-demand audiovisual media services and video-sharing platform services under Article 82a Media Act must pay an annual supervisory fee of 500 Swiss francs.
