Legal basis:

• Art. 21 of the Act on the Free Movement of Persons (PFZG, LGBl. 2009 No. 348) applies to EEA and Swiss nationals

Scope of application:

If a position in a company is held by an EEA or Swiss national with a residence, permanent residence or settlement permit and this position becomes vacant as a result of the person's departure abroad, retirement or death, a residence permit may be issued to a person requiring a permit to fill this position (replacement position). The replacement position requires a permit.

Deadlines:

The application for approval of a replacement position must be submitted within six months of the deregistration, retirement or death of the previous holder of the position.

General information:

If no application is submitted within the deadline, the number of permits to be issued will be increased when the permit is issued or drawn, depending on which procedure was used to issue the original permit.
