Legal basis:

• Art. 19 and Art. 20 of the Act on the Free Movement of Persons (PFZG, LGBl. 2009 No. 348) apply to EEA and Swiss nationals

• Art. 13 in conjunction with Art. 26 of the Foreign Nationals Act (AuG, LGBl. 2008 No. 11) apply to non-EEA and non-Swiss nationals

Scope of application:

All nationals who are gainfully employed in Liechtenstein and do not reside in the immediate border area and cannot pursue gainful employment as cross-border commuters. The B permit entitles the holder to reside in the FL for more than 12 months.

Terms:

As a rule, a decision on complete applications from EEA or Swiss nationals is made within four weeks of receipt. For non-EEA and non-Swiss nationals, decisions on complete applications are generally made within three months of receipt.

General information:

A B permit can only be issued to non-EEA and non-Swiss nationals if they are managers, specialists and other qualified employees who have completed an apprenticeship or have many years of professional experience (Art. 14 AuG in conjunction with Art. 5 ZAV).

Fees:

In the case of a positive decision by the government, the fees are based on the provisions of Art. 10 para. 1 let. a and c of the Ordinance on the Collection of Fees under Foreign Nationals Law (LGBl. 2011 No. 440) and amount to a total of CHF 1,060. In the event of a negative decision, CHF 80 must be collected in accordance with Art. 14 Para. 1 of the Fees Ordinance (LGBl. 2011 No. 440).

With the introduction of the new Fees Ordinance, the Migration and Passport Office charges an advance on costs of CHF 80 in accordance with Art. 7 of the Fees Ordinance (LGBl. 2011 No. 440).
