02/10/2024: Order revoking the provisional frequency allocation to Rivada AG

On 2 October 2024, the Office for Communications (AK) issued an Order revoking ex officio and with immediate effect the provisional frequency allocation Order of 27 February 2023 in favor of Rivada AG. The revocation of the provisional frequency allocation also leads to a revocation of the authorization of Rivada AG to carry out at its own expense international coordination pursuant to Article 88 of the Ordinance on Means of Identification and Frequencies in Electronic Communications (IFV) for all applications and coordination requests for frequency allocations submitted by the Office for Communications to the International Telecommunication Union (ITU) under the designation 3ECOM-1 and 3ECOM-3 as delegated operator of the Office for Communications, as well as the provisional and conditional allocation of individual rights of use to the frequencies which are the subject of the applications/coordination requests to the ITU under the designation 3ECOM-1 and 3ECOM-3. The decision is based on Art. 98 let. b and e of the above-mentioned Ordinance in conjunction with Sections 3 let. n and 7 of the Order of 27 February 2023.

The decision is final, as the appeal lodged against the AK's order was dismissed and the AK's decision was upheld in its entirety. The AK's order can be accessed here.
