Application for an exemption agreement for cross-border teleworking (home office)

Submission

The application can be submitted electronically without a signature.

General remarks:
According to current legislation, applications must be signed by the person submitting the application. With a view to the greatest possible customer orientation and efficient and simple business processing, the office is dispensing with the signature in this case and instead offering the option of electronic submission using a form and without a signature. The signature can be requested subsequently if necessary.

The application for an exemption agreement for cross-border teleworking can be submitted by the employee and the employer. Submission with the personal eID is recommended.

Prerequisites

In accordance with this framework agreement, responsibility for social insurance remains in the employer's country of domicile if employees work for

- one or more employers in the same country of employment,

- employed,

- using information technology,

- less than 50% of working time,

- in the country of residence

perform telework

The framework agreement is only applicable to constellations involving two states that have signed this agreement and to persons who are subject to the EU coordination rules.

Persons to whom these coordination rules were not previously applicable cannot benefit from this framework agreement either (e.g: EU nationals residing in Switzerland and working in Liechtenstein or Swiss nationals residing in Germany and working in Liechtenstein).
