At its meeting on Tuesday, April 15, 2025, the government adopted the consultation report on the approval and implementation of the EU Pact on Migration and Asylum and on the amendment of the relevant laws.
Liechtenstein is part of the European Union's Schengen and Dublin systems. The EU Pact on Migration and Asylum was adopted in spring 2024 after several years of intensive negotiations at EU level. The new regulations will help to prevent illegal entry into the Schengen area and secondary movements within the Schengen area, create more efficient and secure procedures and ensure fair burden-sharing between the member states and associated states.
This proposal implements the requirements that are binding for Liechtenstein due to its Schengen and Dublin association. Of particular relevance to Liechtenstein are the further development of the Dublin system for faster jurisdiction provisions, accelerated transfer procedures and the improved registration of data in the Eurodac fingerprint system.
In addition, rapid asylum and removal procedures are to be implemented at the Schengen external borders to prevent people from continuing their journey irregularly within the Schengen area. Furthermore, in accordance with the principle of shared responsibility and solidarity, Liechtenstein should participate in the solidarity measures on a voluntary basis, which, unlike the EU Member States, are not mandatory for Liechtenstein. Voluntary participation is advocated, as Liechtenstein clearly benefits from participating in a functioning Dublin system and can thus contribute to burden-sharing within the Schengen area.
In addition to the implementation of the EU Migration and Asylum Pact, the present revision of the law also makes adjustments that have resulted from practice in recent years.
