International announcements

In the area of international thresholds, the following three main types of notices are distinguished:

  • Preliminary information
  • Notice
  • Notice of awarded contracts

Preliminary information

The contracting authorities shall, in the case of contracts above the thresholds, except in the case of the negotiated procedure without prior publication of a contract notice, notify, by means of a prior information notice, the works, supply or service contracts which they intend to award in the coming twelve months.

Contracts above the threshold values, except in the case of negotiated procedures without prior publication, must be published by means of a prior information notice in the Liechtenstein official publication organs in German (Article 14a, Paragraph 4 ÖAWV), as well as forwarded to the Office for Official Publications. The contracting authority may send this prior information to the Office of Official Publications for review ten days before its publication. Proof of publication shall be a confirmation of publication issued by the Office for Official Publications of the European Union, indicating the date of such publication (Article 14a, paragraph 1 ÖAWV).

The content of the prior information notice is governed byArticle 14, paragraph 3 of the Public Procurement Ordinance.

The transmission of the prior information notice to the Office for Official Publications must be carried out within the shortest possible time and by electronic means in compliance with the information set out in Annex VIII, point 3, of the Directive 2014/24/EC on designs and procedures to be made.

The period of time between the prior information notice and the contract notice must be at least 35 days and not more than 12 months, otherwise a prior information notice must be published again. A prior information notice results in a shortening of the deadlines.

The contracting authority may also publish the preliminary information in a procurement profile. He notifies the Office for Official Publications of the European Union in advance by electronic means of the publication in a buyer profile. The contracting entity may set up the buyer profile on the Internet; it contains information on planned and ongoing procurement procedures, on contracts awarded and all other information relevant to the award of the contract, such as the contact point, telephone and fax numbers, address and e-mail address of the contracting entity. The prior information may not be published in the Liechtenstein publication organs before publication by the Office for Official Publications of the European Union. However, the publication in the Liechtenstein publication organs may take place if the contracting entity has not been informed of the publication within 48 hours after the confirmation of receipt of the prior information notice (Article 14, paragraph 3 and 4 ÖAWV). It may only contain the information that has been forwarded to the Office for Official Publications of the European Union or published in a buyer profile and must indicate the date of transmission to the Office for Official Publications of the European Union or publication in a buyer profile.

Announcement

The intended award of public contracts must be published by means of a public notice (advertisement) in the Liechtenstein official publication organs in German (Article 17, paragraphs 1 and 2 ÖAWV), as well as to forward it directly to the Office for Official Publications. Transmission of the notice to the Office for Official Publications of the European Union shall be effected as soon as possible and by electronic means, in accordance with the indications in point 3 of Annex VIII to the Directive 2014/24/EU on patterns and procedures for transmission. 

Public contract notices shall not be published in the Liechtenstein official publication organs prior to publication by the Office for Official Publications of the European Union. However, publication in the Liechtenstein official publication organs may take place if the contracting authority has not been informed of the publication within 48 hours after the acknowledgement of receipt of the notice.

Notice of contracts awarded

contracting authorities shall send a notice to the Office for Official Publications of the European Union within 30 days after the award of works, supply and service contracts or after the conclusion of a framework agreement or a competition has taken place. The sender must be able to prove the date of dispatch. Proof of publication shall be a confirmation of publication issued by the Office for Official Publications of the European Union, indicating the date of publication (Article 42, paragraph 1 ÖAWV).
The content of the notice of awarded contracts is governed by Article 42, Paragraph 1 of the Public Procurement Ordinance.

In the official publication organ, the awarded contracts are published with the template "Notice of awarded contracts"

In the case of framework agreements, a notice containing the results of the respective award procedure does not have to be sent out for each individual contract awarded on the basis of this agreement (Article 42, paragraph 4 ÖAWV).

The contracting authority shall send to the Office for Official Publications of the European Union, within 30 days after each contract award, a notice containing the result of the award of the individual contracts awarded under a dynamic purchasing system. However, he may summarize this notice on a quarterly basis. In this case, it shall send the compilation within 30 days after the end of the quarter (Article 42, paragraph 5 ÖAWV).

The contracting authority may summarize and publish the notice of award of contracts for social and other special services on a quarterly basis. In this case, it shall send the compilation within 30 days after the end of the quarter. Information on the award of a contract or the conclusion of a framework agreement need not be published if its disclosure would hinder the execution of the law and regulation, be contrary to the public interest, harm the legitimate commercial interests of public or private enterprises, or affect fair competition between them (Article 42, paragraphs 3 and 6 ÖAWV).
