Need for recreation
General
A legitimate interest exists if the property to be acquired serves the acquirer or family members living with him/her in the same household to meet a current recreational need, the acquirer is an adult national residing in Austria, and neither he/she nor any of his/her family members already own a corresponding property.
Eligible Persons
- Liechtensteiner/innen, Swiss and EEA nationals residing in Liechtenstein;
- Liechtensteiner persons can claim a recovery requirement for their beneficiaries (see for this acquisition by a foundation, an institution without members or a trust similar to a foundation).
Location of the property
The property to be acquired must be located in the vacation and alpine area.
Properties in the vacation and alpine area are those located above 1100 m above sea level.
Allowable number of plots
Neither the purchaser nor a family member of the purchaser living in the same household may already be the owner of a corresponding plot of land in the vacation and alpine area.
The acquisition of land in the vacation and alpine area shall be examined for the existence of a legitimate interest without regard to the ownership in the valley area.
Acquisition of joint ownership
Acquisition of joint ownership of a plot of land shall be treated in the same way as acquisition of sole ownership of a plot of land. Thus, the acquirer of a co-ownership share must also meet the above-mentioned personal and material requirements.
