Labeling food and utility articles

Food

In the Lebensmittel- und Gebrauchsgegenständeverordnung, the specifications for correct labeling are also given within the framework of the general requirements for foodstuffs. The basic principle is that all information must correspond to the facts and must not be suitable to deceive the consumer. In addition, the labeling must be in a clearly visible place in easily legible and indelible writing in an official language. How the information must be provided in detail is regulated in the Verordnung des EDI
betreffend die Information über Lebensmittel (LIV).

Special labeling and promotion of the individual types of food are regulated in the product-specific ordinances of the food legislation.

Depending on the product and the sales situation, further provisions of other ordinances may apply, e.g. the

  • Additional Substances Ordinance 
  • Quantity Specification Ordinance
  • Price Announcement Ordinance
  • Agricultural declaration ordinance
  • Organic Regulation 

Since correct labeling can be very costly and complicated for some products, there are institutions that specialize in  labeling and also in manufacturing labels. Our office can provide you with an overview of such institutions. 

For resource reasons, our office can only assess simple labeling. The effort made will be charged.

Utility articles

On the packaging (= repackaging) of cosmetic products at the time of marketing, under the term "ingredients", the list of ingredients in descending order of quantity must be provided.

On the packaging (= repackaging) and the container of cosmetic products, at the time of placing on the market, the following information must be provided:

a. the intended use, unless this is apparent from the presentation;

b.the name, business name and address of the manufacturer, importer, distributor or responsible person;

c. the minimum preservation or best-before date until which the cosmetic product will perform its original function when properly stored, indicated in the order month and year or day, month and year preceded by a pictogram or the words "best before";

d. if the minimum durability is more than 30 months, the indication of the date of minimum durability is not mandatory; for such products, it is indicated how long the product is safe after opening and can be used without harm to the consumer;

e. if necessary, the storage conditions that must be observed to ensure the stated minimum shelf life;

f. the batch number or mark enabling the cosmetic product to be identified;

g. Warning statements and at least the mandatory statements depending on the ingredients and, if applicable, special precautions for cosmetic products for professional use.

For other articles for use, there are extensive to almost no labeling requirements. Special importance is attached to the hazard statements and instructions for use. Detailed requirements can be found in the corresponding regulations.
