Legal basis

According to Art. 20 of the Communications Act (in German), the Office for Communications has to examine ex officio whether there is effective competition on the markets for electronic communications in Liechtenstein. If there is no effective competition, i.e. if one or several providers have significant market power, the Office must take necessary special regulatory measures to eliminate the competition problems identified. This procedure is called market analysis.

The existence of significant market power is to be determined mainly on the basis of the criteria set out in Art. 31 of the Ordinance on Electronic Communication Networks and Services (in German).

If the Office for Communications identifies one or several providers with significant market power in a defined market, it will initiate necessary appropriate measures of special regulation suitable for eliminating the competition problems prevailing in the market concerned.
