Superstructure

General

A legitimate interest exists if the land to be acquired is for a condominium or rental housing development or for the creation of commercial premises.

The following requirements must be met:

  • the superstructure must contribute to meeting the domestic demand for condominiums or rental apartments or commercial premises; the construction of a single-family house or a single business premises is not a superstructure within the meaning of this provision;
  • a preliminary project including a construction description must be submitted for the superstructure;
  • the planned overbuilding must be in reasonable proportion to the land area and be carried out within the time specified;
  • the superstructure must comply with local and national planning regulations and guidelines;
  • the purchaser must be a Liechtenstein or EEA national or a legal entity with its registered office in Liechtenstein;
  • the acquirer must not be the owner of a plot of land ready for construction, which would be suitable for a superstructure within the meaning of this provision;

Foreign use

The planned overbuilding must serve the third-party needs, i.e. the construction of rental or condominium apartments or commercial premises for third parties. A minimum of owner-occupied use is permitted, but in no case may it exceed 30% of the area.

Condition, location and permissible size

The land to be acquired must be located in the zone permitted for the proposed superstructure.

Generally, the land to be acquired is not yet overbuilt. A built-up plot of land can be acquired if:

  • the building is demolished and the land is built over according to the submitted preliminary project;
  • the building is integrated into a development according to the submitted preliminary project; or
  • the building according to the submitted preliminary project is fundamentally renovated.

The ratio between the total area of the property and the area to be used for the planned superstructure must be reasonable.
