In the context of a building application procedure, the noise immissions emanating from a planned restaurant are to be assessed by the Office for the Environment on a case-by-case basis in accordance with Art. 14 of the Environmental Protection Act (USG), LGBI. 2008.199. Likewise, according to the requirements of the Ordinance on Air Pollution Control (LRV), LGBI. 2008 No. 245, emissions relevant to air hygiene and odor-polluting exhaust air must be recorded as completely as possible close to the point of origin and discharged in such a way that no excessive immissions occur. An assessment is carried out in a first step using the form for restaurants, which must be submitted by the building owner together with the building application.
