Acquisition as part of an estate

General

A legitimate interest is not required when real property is acquired pursuant to a will, codicil, inheritance contract, or bequest agreement.

Donation on death is not covered by this provision, i.e., there must be a legitimate interest for the acquisition of real property.

Template for approval

The contract of inheritance and the bequest contract do not have to be submitted to the land transfer authority for approval when they are concluded, but only with the corresponding court order of inheritance.

The same applies to a will.
