Is the order value to be calculated exclusively or inclusive of VAT?

The contract value is calculated in accordance with Article 8 paragraph 1 of the Law on Public Procurement or Article 23(1) of the Act on Public Procurement in the Field of Sectors, excluding value added tax determined.

What is the difference between the suitability criteria and the award criteria?

The suitability criteria are mandatory criteria that must be met and generally refer to the characteristics of the applicant or offeror.
The award criteria generally relate to the subject matter of the contract. These can be fulfilled differently, which can lead to correspondingly different evaluations of the individual offerers.

What is the difference between an open procedure and a restricted procedure?

Non-open procedures are a two-stage procedure. Both procedures must be published in the official publication organs. In the restricted procedure, however, only the application documents are received in the first stage, and not the tender documents as in the open procedure. On the basis of the submitted application a number of applicants defined in advance will be invited to submit an offer on the basis of the criteria in the application documents.

Is it permissible to refer to brands or manufacturers in the tender documents?

The description of the subject matter of the contract shall be in a neutral form, without references to trademarks or manufacturers. If reference is made to trademarks or manufacturers for compelling reasons, the reference must also refer to equivalent other products or processes (Art. 18 ÖAWG) or (Art. 30 ÖAWSG). This can be done, for example, with the reference "or equivalent"

At what award amount is a complaint possible?

From an award sum of CHF 200,000 an appeal is possible. For a construction contract above the EEA/WTO-thresholds an appeal is also possible below an award sum of CHF 200,000, provided that it is not an exception clause pursuant to Article 9 paragraph 3 and 4 ÖAWG or Article 24 paragraphs 3 and 4 of the Law on Public Procurement in the Sectoral Field acts.
