GDL provision of architects, construction managers and engineers in the construction industry for companies from EU/EEA states or Switzerland

The cross-border provision of services (GDL) in the field of the Construction Professions Act (BWBG) is subject to licensing and concerns the following activities:

Prior to providing a GDL under the BWBG, a notification must be filed online with the Office of National Economy (AVW) and the required documents must be submitted. The activity may only be commenced after the AVW has issued its approval.

Form

Notification for cross-border professional practice for architects, construction managers and engineering professions in construction

When entering the form, choose between the two options "New grant" and "Renewal" and then indicate the legal form of your company as well as the BWBG profession you wish to practice in Liechtenstein. The application can be submitted electronically by clicking on "send" without a personal signature. Please note that certain documents cannot be uploaded in the form, but must be submitted in the original by mail or as an electronic original, i.e. as a digitally signed extract. Select: "will be submitted subsequently" in the form.

Requirements for admission

  • Specialist suitability and entitlement to exercise the profession: nationals of an EEA member state or Switzerland who are legally established in one of these states and are currently entitled to exercise their profession there on a self-employed basis are admitted to exercise the profession in Liechtenstein on a temporary and occasional basis across borders. The professional suitability and current authorization to practice the profession must be proven.
  • Reliability: The granting of the cross-border license under the BWBG is also dependent on the reliability of the sole proprietor or the managing director of a legal entity. The reliability must be proven.
  • The GDL provider must have a professional liability insurance that covers a damage of at least CHF 1.5 million and is maintained during the GDL provision.

Documents to be submitted

All documents must be available in German, any foreign-language diplomas, certificates of ability and employment certificates must be translated and officially certified. The documents marked with * must be submitted in original (by mail) and must not be older than 3 months at the time of application

  • ID or passport copy
  • Confirmation of residence* (=Meldebescheinigung [AT])
  • Proof of authorization to practice profession in home country: extract* from trade or commercial register or company register
  • Proof of professional competence through specialized training: Diplomas, certificates of training. In the event that the profession or the training of the service provider is not regulated in his country of establishment: proof that he has independently practiced this profession there for at least two years during the previous ten years, reference or work lists, work certificates.
  • Proof of reliability: One extract each from the criminal record* (=criminal record certificate [AT], certificate of good conduct [DE]) and the debt collection register* (=execution register (AT], debtor's register [DE]) , if necessary additionally an extract from the debt collection register of the applying company. The AVW accepts in the latter case also a notarized, affidavit* of freedom from debt and seizure.
  • Proof of professional liability insurance: copy policy or proof of insurance of a professional liability insurance, minimum insurance sum CHF 1.5 million or equivalent in foreign currency.

Renewal

The approval is granted for one year. It can be extended for one year up to six months after its expiry. If the data disclosed in the previous application has changed or if the last confirmation/extension has expired for more than 6 months, the registration confirmation must be applied for again. The application for renewal must be accompanied by a current confirmation of legitimacy to practice the profession in the country of origin (excerpt from the Commercial Register/Company Register/Trade Register, not older than 3 months)

Registration requirement

The cross-border professional must notify the AVW in writing of any significant changes from the situation previously presented, enclosing the documents. The notification shall be made within 14 days of the occurrence of the change.

Fees

No fees are charged for admission to cross-border professional practice.
