Acquisition by way of compulsory auction
General
A legitimate interest is not required when a property is sold by foreclosure, provided the winning bid is awarded to a person of legal age who meets one of the following requirements:
- Liechtensteiner/in or EEA national with or without residence in the country;
- Swiss nationals residing in Switzerland;
- Juridical persons domiciled in Switzerland or the EEA;
Force auction - Voluntary auction
Forced auction within the meaning of the Land Transfer Act shall mean the executive auction on the basis of an execution title in the sense of a judgment for payment of a debt in favor of the creditor or the creditor with other execution.
The cancellation of co-ownership and joint ownership in the auction procedure does not fall under this provision, i.e. there must be a legitimate interest for the acquisition of a property.
