Damages

The provisions concerning damages can be found in Article 61 of the Public Procurement Act or. Article 77 of the Law on Public Procurement in the Field of Sectors.

Offerers possess a legal right to compensation for damages caused to them by contracting authorities as a result of decisions or orders whose illegality has been established. The claim for damages shall include the expenses incurred by the offeror in connection with the award and appeal proceedings. Unless otherwise provided in this Act, the provisions of the Public Liability Act shall apply mutatis mutandis.
