VwbP- Application for the transfer of responsibility for a legal entity
Submission
There are two ways to submit an eForm to the Office of Justice, Foundation Supervision and Anti-Money Laundering:
- The eForm can either be submitted online using an eID. The personal data will be automatically entered into the form; or
- The eForm is printed out after completion and submitted to the Office of Justice, Foundation Supervision and Anti-Money Laundering, with the original signature(s) of the member(s) of the executive body of the respective legal entity with signature authority.
When submitting the eForm via eID, please note that a form can only be submitted by one person via eID. For example, if a legal entity has two members of the executive body with joint signature authority, a separate eForm must be submitted online for each of these persons using eID. Before submitting, the eForm can be sent to members of the executive body with signature authority using the function “Zwischenspeichern” and then selecting the “per Mail versenden” option, who will then receive a pre-filled eForm.
Prerequisites
The legal entity must ensure that access to the VwbP is always guaranteed for the purpose of fulfilling the legal obligations regarding the registration and notification of changes on the part of the legal entity. If a change regarding the responsible person (user) is to take place, there are the following two options:
- The access data of the user account in question is adapted (e-mail address, first name, last name and password). By doing so, the entire user account is "overwritten". In the adapted user account, all legal entities assigned to this account appear. Additional applications do not have to be made.
This option is applied in particular if all legal entities assigned to one user account are to be transferred (e.g. change of the employee previously responsible for the VwbP). - The user waives responsibility separately for each legal entity. The new user subsequently requests each legal entity individually in the electronic system of the VwbP and submits the original signed form for the transfer of responsibility for a legal entity to a user account ("Rechtsträger anfordern") electronically or as an original to the Office of Justice, Foundation Supervision and Anti-Money Laundering.
It is important that the necessary steps are taken before the current user no longer has access to the VwbP.

Before submitting the application form for the transfer of responsibility for a le-gal entity to a user account ("Rechtsträger anfordern ") to the Office of Justice, Foundation Supervision and Anti-Money Laundering, the legal entity must be requested in the electronic system of the VwbP in a first step.
The application form is to be submitted to the Office of Justice, Foundation Supervision and Anti-Money Laundering, electronically or as an original only after taking this step. Both steps are required for the application to be approved.
If a legal entity cannot be requested in the VwbP, the current user is to be contacted directly. A legal entity can only be assigned to one user account at a time.
An improvement order will be issued if the requested legal entity is not specified in the section "Antragsteller/in", the "Übernahme in folgendes Benutzerkonto" section does not contain the details of the new user, or the "E-Mail-Adresse Benutzerkonto" is not identical to the "Account mail" specified in the online portal.
If a legal entity is represented by a legal person as a member of executive body, the company name/name/designation of the legal person as well as the first and last name(s) of the natural person(s) representing the legal person must be stated. This serves to verify the power of representation/legitimacy of the application.
